HOA ELECTION REFORM (FS 720.306)
Talking
Points: HOA election provisions (FS 720.306) allow a sitting board
to get re-elected without giving the opposition a chance to really have an
opportunity to get elected. Starting with a “Nominating Committee” the board
can “legally” eliminate unwanted candidates from the ballot. Why not using
the condo election provisions to replace the faulty provisions we have in
the moment in the HOA Act. These provisions are effective and easy to
control, combined with lots of arbitration case law showing exactly what’s
right – and what wrong. FAIR ELECTIONS should be in everybody’s mind
after the disaster of the November elections.
REMOVAL LIENS FOR FINES (FS
720.305)
Talking Points:
Only the Florida
HOA statutes allow liens for fines. Not only are fines unconstitutional (an
HOA is NOT a government entity), but this provision is as well
used to blackmail owners criticizing the board and is as well used to keep
“unwanted” owners from running for the board.
MANDATORY EDUCATION AMENDMENT
Talking Points:
Board members can
bankrupt the private finances of each owner. They should be forced to get
educated before making decisions – and not just sign a useless affidavit
claiming that “they know it all.” Some good education by a seminar (with
Q&A) should help especially board members to do the right things – giving
them some basic knowledge how an association should be run.
POLITICAL SIGNS
Talking Points:
Every year the
fight over political signs makes attorneys rich and owners poor. Neighbors
fight neighbors and threatening letters are written. Let’s create some
reasonable rules for the posting of political signs within certain
time-limits.
